Have your say on Council's draft policy and planning proposal for burials on private land.
Bega Valley Shire Council has resolved to support a planning proposal to amend the Bega Valley Local Environmental Plan 2013 (BVLEP 2013). Council will prepare a draft policy and associated draft procedure to formalise requirements and create an exempt development pathway for burials on private land in certain zones.
The draft policy and amendment to BVLEP 2013 will clarify when approval is required under the Environmental Planning and Assessment Act 1979 for burials on private land in the Bega Valley Shire. The draft policy and planning proposal would apply to burial of up to four bodies on land over five hectares in size zoned RU1 Primary Production, RU2 Rural Landscape or C3 Environmental Management.
The draft procedure sets out specific environmental, water protection, access, grave and information standards required for burials enabled by the draft policy.
This draft policy and procedure will be exhibited for a period of at 28 days (27 August 2025 to 23 September 2025). To allow sufficient time for feedback, public submissions can be received until 7 October 2025.
Submissions must include your full name and address, contact details, signature and political donations or gifts disclosure.
Under the Government Information (Public Access) Act 2009, details of your submission, including your name and address will be publicly available on request. You can request that your name and address not be disclosed by writing “objection in confidence” on your submission, however Council may still be obliged to release these details. Submissions that do not contain the author’s name and address may not be considered as Council will be unable to validate their authenticity.
Council is authorised as the local plan-making authority to exercise the functions for this planning proposal.
